The Privacy Guarantor fined Deliveroo for 2.5 million euros

The home delivery service, controlled by the British company Roofoods, was found guilty of several crimes, including allowing access to personnel data to other companies, including non-European ones, and having carried out a continuous geolocation of the riders. .

The verifications by the Guarantor have revealed that the company has unlawfully processed the personal data of about 8 thousand people employed in the delivery services. In fact, the company would have kept the data collected during the execution of orders - including communications with customer support - for a longer time than required by the Regulations for the protection of personal data (GDPR). The investigations then showed how Deliveroo carried out an illegal check of the work performance of its employees, by detecting their position every 12 seconds and keeping their paths for 6 months. In addition, further offenses concerned the lack of transparency with respect to the algorithms used for the management of the riders, both for the assignment of orders and for the booking of work shifts.

For this reason, the Guarantor fined Deliveroo with a 2.5 million euro fine and granted the company 60 days to correct the violations found and 90 days to complete the interventions on the algorithms. The company must therefore provide riders with precise information regarding the functioning of the algorithms that manage orders and work shifts, as well as guarantee the right of workers to obtain human intervention capable of correcting the system, in the event of discrimination.

After the € 2.6 million fine imposed on Foodinho, this is the second sentence issued in two months by the Authority, with respect to the working conditions of the riders. In fact, since 2019, the Guarantor has been investigating the methods of managing the workers of some of the main home delivery companies operating in our country.
